The government has published drafts of the new forms for tenancy processes that need to be used under the Renters’ Rights Act.
Following publication of the Information Sheet that should be given to tenants by 31st May, these forms are currently for reference only so that landlords can see what information they’ll need to include, but un-watermarked versions will be on the assured tenancy forms page on 1st May.
The six new forms include the notice proposing different terms for an assured tenancy and application referring a notice proposing different terms for an assured tenancy “arising by way of succession under the Rent Act 1977 or the Rent (Agriculture) Act 1976 to the tribunal in the private rented sector”.
Guidance
The forms also include guidance for private landlords about completing possession notices, and the legal wording for possession grounds as well as a form for the notice proposing a new rent for assured tenancies.
The government explains that for landlords who serve a valid section 8 or section 21 notice before 1st May - and that notice has not expired immediately before that date - they should continue using current forms.
However, they can only continue using the current forms on and after 1st May if: they have not started the court process and the deadline for starting it has not passed, or they start the court process for possession before 1st May, and those proceedings have not finished, or they start the possession process before 1st May, and the case is delayed because the tenant has entered a breathing space.
