Default Serving s.21 Notice- what dates?

I have got a tenant whose tenancy started on 22nd February (which was a monday) she pays her rent weekly due on a friday for the following week. To issue her with a section 21a (as has gone periodic) do I need to give her two months plus notice from now 29th July to terminate on the 21st of October or as her rent is payable on a Friday and she started the tenancy on a monday would giving notice on Friday August 6th to terminate on Sunday the 10th October be ok. Am i right in thinking that the the tenancy period is monday to sunday as she pays weekly

What does the tenancy agreement state about the frequency of payments?

Default section 21a confusion over dates

hi, hope somebody can help. I have a tenant that has started to become a nuisance to her neighbours (also my tenants) and i have decided she has had enough chances. she moved in on Monday february 22nd she is a weekly payer her rent is due on a friday to pay for the following week. My question is do i fill in the section 21 to give her 2 months notice as the 22nd of the month is a new rental term or does her rental period start on a monday and end on a sunday? I know that either way i must give her two months clear notice plus a day or two to be on the safe side

so do i date the notice requiring possession say friday 6th august to 10th october or do i have to give her it before august 22nd to end on October 21st

it says it is payable in advance on the Friday of each week. Payable four weeks in advance

If you are currently in the fixed term, you issue a s21(1)(b) giving 2 months notice - the expiry can be on any day.

If the fixed term has ended, you issue a s21(4)(a). This must have a Sunday as the expiry date.

In both cases, use the format "after date month year" including the word "after". Make sure you get proof of service.

thanks you snorkerz have used the secton 21 available from the landlordzone. have have posted one copy obtained proof of postage and hand delivered another with a witness (hoping to cover all bases) now i will crossmy fingers she just goes

1. On what date (and day of the week) did the Tenancy begin?
2. T pays rent weekly, but is that what the Tenancy Agreement stipulates?
3. Is rent due weekly (or monthly) in advance or in arrears?
4. Did you issue a Rent Book etc? See s.4 of LTA 1985.
5. What is the fixed term of the Tenancy Agreement?
6. Is the property in England & Wales?
7. Is the rate of rent £25 000 or less per year?

Two threads by the same member have been merged here. Please do not start a new thread if you merely wish to continue a previous discussion or report on subsequent developments. It can cause unnecessary confusion (quite apart from losing the connection with facts previously established or legal points previously explained).
