Default Workmens unauthorised entry

Dear All,

We've recently had some decorating works done to the front of our building (4 flats).
Arrangements were made with one of the tenants (mine) to allow access for electricity for the workmen.
Works were finished, and not satisfactorily, needing rework that was only commenced some two months later.
This time arrangements were made with one of the other flats for electricity.
The decorators completely ignored the specific instructions and collected the keys to my flat from the letting agent.
The first I know of anything is when I get a distressed call from my tenants about the decorators having let themselves into the flat whilst they were at work without permission.
This of course has now stopped.
The letting agent apologised for not checking with me first, but assumed things were OK since they collected the keys from them the first time a couple of months before.

I'm furious this has happened and want to know what the situation is with this incident? Is this a criminal, civil, nothing, or something else matter?

Thanks
Lulu

Both the agents and the decorators have breached their obligations, but as there has been no financial loss then it has gone pretty much as far as it is likely to - ie, everyone has said sorry.

I would be encouraging your agents to send a bouquet of flowers at their own expense to your distressed tenant.

  • TENANTS: Just because you have a right to do something, does not prevent your landlord evicting you through the section 21 process. Where ever possible - negotiate
