    Default discretionary housing benefit payments

    Good afternoon
    I have a tenant who's falling behind in her rent
    She is working part time, has 2 children and can't afford to cover her rent
    Could she be entitlement to discretionary housing benefit payments?
    Where could i learn the inns and outs of discretionary housing benefits?
    Are there some good articles available on this and housing benefit in general?

    She would be entitled to claim a Discretionary Housing Payment only if she has entitlement to Housing Benefit and this is in payment.

    I would suggest looking on your Local Authorities website to see what they say about their DHPs. A DHP as it says is discretionary and down to who ever assesses your tenants application. They will take all their circumstances in to consideration, including all income and expenditure. It should also not be seen a long term solution to a rent shortfall.

    DHP's are not a benefit, nobody has a right to claim a DHP, as the name says they are discretionary payments made by the council from the social fund.

    You normally need to be claiminh Housing Benefit (or Universal Credit Housing Element) to get a DHP.

    They could be in the form of a one off payment, or in the form of help with regular rent payments.

    They are meant to help out with short term problems. There is no guarantee that even if regular payments are granted they will continue.

    However from what you say I get the idea that your tenant is not claiming HB already?
    In which case she should try making a claim for HB on low income grounds.

    This is not a market I would touch with a barge pole. But having said that -- if you do, I would not get involved at that interface. It is up to your tenant to arrange her finances, benefits etc., not your role as a landlord/social worker.

    It is not a role you want to take or should take.

    DHP is given based on different rules: You would need to see what the rules (guidelines) are your THAT council .. e.g. (17 page long document for Slough..)

    Don't take what your mate the landlord down the pub says, see what the policy says for THAT COUNCIL... Your mate might know about a different council's approach.

    Trouble is they are discretionary: And the DHP budget often runs out...
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
