A year ago, we acquired a franchised business which has an existing commercial premise. The franchisor required us to have the lease assigned to us by the landlord. The lease was drawn up for a 5 year term. We have since found out that the lease is unsigned, however the franchisor has been paying the rent directly to the landlord and we have been reimbursing the franchisor for this. Can anyone provide details as to our legal position and would the franchisor being able to rescind the lease or as the franchisor had been occupying the premise and paid the due rent are they bound by the unsigned lease.
