    Default Hmos , can our son be considered the landlord?

    My husband and I are buying a house for my student son (18) to live in. The mortgage is only in my husband and my name.

    I understand that if a landlord lives in a house there can be 2 unrelated lodgers. Could our son be considered the landlord?

    We are in Scotland .

    Is the house in Scotland also>>??? If so are you registered as landlords??
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

    Are the mortgage lenders aware that you will not be living there, ie is it on BTL terms?

    I believe your son could be your tenant, and you could allow him to take lodgers who are not on your tenancy agreement, but I am not sure of the specific letting arrangements relevant in Scotland. If the property is in Scotland you may be better re-posting this on the specific "Scottish lettings" part of the forum.

    The house is in Scotland, we are in the process of buying it. We are not yet registered as landlords.

    I too am doing the same, we are buying a flat and our son is the main tenant, where do we stand with regards the tax from income from him paying the rent... we are paying the mortgage out of the rent, the service charge , gas maintenance charge etc... We are re mortgaging our house to buy the flat outright, he then rentsit from us at market rate. So where do we stand on tax and do we need a tenancy agreement?
