    Exclamation Urgent Sub-Letting Enquiry

    Dear All,

    I am one of the Directors of a company which with a freehold lease on a D1 Commercial property, Landlords of which have given consent for us to sub-lease. We are seeking some advice on how to create a subcontract for the subsequent subletter. Do we include the same terms and conditions of our own contract with the Landlord, in the sub-contract?

    Any advice and guidance offered would be greatly appreciated.

    I would seriously think about getting an experienced solicitor to draw up that agreement - you need only do it once and copy it for further uses.

    Yes.

    Even though you sublet, it's still you that has to obey the initial
    contract, and if your sub tenant violates any of your obligations
    in the contract, it's you who is to blame, as you are the one with
    the contract with the landlord.

    Therefore your subtenant has to be told the conditions that you
    have to obey.

    As stated, see a solicitor.

    Thank you both for your valued advice.
    I have shared with the board of directors and we are in now in the process of setting an appointment with a Solicitor to discuss.
