    Default Joint tenancy agreement, fixed term lease, one tenant wants to leave

    Hello everyone,

    We are three tenants under a joint tenancy agreement with a fixed-term lease of one year. There are 3 months remaining until the end of the lease.

    One of the tenant has decided to simply leave at the end of the month, with no notice for the landlord, the agency, or for the other 2 tenants (including me).

    My questions are therefore as follows:

    - Please confirm that the other 2 tenants are expected to continue paying the full rent, and that the agency can sue them if only part of the payment is made
    - Is it possible for us to sublet the room of the tenant leaving? If the agency refuses to sublet, is it a valid clause to break the contract?
    - We live in Ireland. Can we go and reach the PRTB to ask the tenant that is leaving to pay his part of the rent?

    Finally, can you advise on what our best option is?

    This forum only deals with lettings in England/Wales. The law is different in other jurisdictions so we cannot advise.

    Well, see about starting one!
    Maybe an Irish Law Society etc. (or a representative organisation of landlords and/or tenants) would like to look at the wonderful LZ (E&W mainly, plus a Scottish Forum) as a good model upon which to base theirs.

    I don't think that LZ ought to cover the law of foreign (non-UK) countries.
    Ireland [= Eire] left the UK in 1922. It was in all the papers!
