It seems you've made a right mess of this. You need to serve a s48 on your tenant, otherwise rent is not lawfully due, and then return the deposit and issue a s21 notice. In this situation i think...
If you wanted you could try and pursue tenant for rent in lieu of notice. It might be better to simply accept the offer of surrender immediately and relet the property as soon as possible.
Nothing to do with your question but is your tenant a man or a woman? It starts as a woman, becomes a man, and then a woman again at the end of your post?
You can't serve a s21 as you didn't protect the deposit. You can serve a s8 but it has mandatory and discretionary grounds for eviction.
Are they behind with the rent?
You acted reasonably in my opinion. There was nothing wrong with the installation so you should pay. If there had been a fault your landlord would have paid.
You made the mistake so you should pay.
Personally I now don't take tenants with ccj's as these seem to be the ones I end up having trouble with. Of course there are many decent ppl like you who made a mistake in the past and wouldn't...
True. I think the trade off in this case is that corporation tax will be liable on all profits and if I wanted to extract profit from the company I would be liable for income tax, therefore there...
Sorry to hear about this Snorkerz. I'm am in the process of claiming from a guarantor also but I suspect this will get dismissed also. My policy now is no HB, no guarantors etc. The judges and the...
Legislation that is concerned with the fabric of the building has nothing to do with whether a landlord supplies a toaster or not.
ARLA have stated the position and this has been previously...
You reference a report that is concerned with the repair of the premises itself i.e. the building
Yes. I imagine my claim will go undefended and I can apply for a default judgement. After that I quite like the idea of summoning an ex tenant to court to explain why they haven't paid, sounds like...
I registered with MCOL and started a new claim and you can claim against two people at two addresses so that's good.
If i recover any money then that would be great. If not they will have a CCJ so...
Well, if a tenant buys a new kettle and uses it exactly as they are supposed to, but after a year it stops working because it is completely scaled up inside who's fault is it? It's not really the...
Yes, i did concede to the point at that time. But since then i have have clarification from legal professionals working in this area that it is a total misreading of s11 to believe it can somehow...
Haha, oh dear.
I did state in my post that others don't agree with me. My belief is that s11 is not related to appliances that are supplied by the landlord. Those who believe that s11 is...
I used findermonkey to trace my tenant and they were very good. Using the internet i also researched the property she moved into and discovered the estate agent who let the property to her. I thought...
In addition to this (although i know not accepted by others)
I would argue if the contract is silent on this point and there is no express term stating tenant is responsible then it's an implied...
Because I think it fair that the tenant gets a CCJ too, so make things a little more difficult for them and also to serve as a warning to other landlords.
The OP stated that she returned to the property to collect mail and discovered the letter from the court with the ruling. She also claims that she served notice in December and moved out early Jan....
I want to issue a MCOL for unpaid rent for a tenant that abandoned a property. They have a guarantor who has a good job, the tenant doesn't. I want to get a judgement against the tenant so that it is...
Payment history is good. Condition of the property is not great and relations with the tenant not great. I assume it's probably for a mortgage application as I haven't really heard of this for a...
Would it make any sense for a tenant to ask a landlord for a reference for a bank loan?
When did you give notice and what form did it take?
Best not to refer to either a prospective tenants age or sex as there is various legislation covering this. you should think of a way of advertising it without reference to:
age;
disability; ...
