Three points:
1 Does East Lothian not already have a Citizens Advice Bureau providing the same service.
2 Shelter offers a national helpline could East Lothian Council not just refer their...
My source is Shelters Annual Report 2011/12. Having checked it in full the reserves are 22 million (not 30) and the 10m is correct.
All the services you describe are available from Citizens advice.
The trouble with Shelter is that they do not actually supply accommodation so any accommodation they secure for a homeless person...
TIPs and LR Number on Adverts were announced in late 2011 in the Private Rented Housing (Scotland) Act 2011, and came into force on the 1st June 2013 and 1st May 2013, I hardly call that a very small...
Each to their own I suppose.
Personally I would support Moonbeams before I would support Shelter.
Most landlords are not aware of Tips, IMO enough has been done to make landlords aware of this obligation.
When I was in history at school they used to talk about how in war troops would march...
6. Consult with stakeholders to examine the sustainability ad effectiveness of the current PRS tenancy regime.
This is the most important issue, the PRS is really geared towards...
I have no problems with legislation being introduced regarding electrical safety.
I do though think it would be unfair to only apply it to the PRS. It should also apply to the social rental sector...
I think the answer you are looking for is that you would submit an amendment to the court at five months so that the court know that five months rent are outstanding.
I would imagine that one of...
Point 2 Is good to know.
Point 1 The legislation can be amended.
I know that City of Edinburgh Council had been asking HMO landlords to remove non working fires from properties based on advice from T C Young.
However it is my understanding that they had...
Does the inventory say that the gas fire is capped off and if so have you signed it?
I have no Statistical information whatsoever. I do though see holes in the methodology being used to calculate the statistics given.
Safe Deposit Scotland appear to be basing the expected deposits...

Here is an interesting blog on the legal position of this issue.
The Scottish PRS is coming under increased political pressure.
What particularly annoys me is the use of statistics in these attacks.
The latest dodgy statistic estimates that up to 56% of...
The rental industry in England and Wales is moving forward in a modern commercial fashion.
Meanwhile the rental industry in Scotland is getting dragged backwards by the Scottish governemnt and...
When the 1988 act was introduced the government planned to remove the parts of the 1984 act that were now irrelevant.
As a protest against the 1988 act Scottish Mps led by East Lothian MP John...
The 1984 act should be scrubbed from statute as it has no relevance to the post 1988 rental market. Once again Scottish landlords have been left exposed by the Scottish government as they diverse...
Under section 1a I would say that this could be construed so that rent in advance could be regarded as a deposit.
It is unlikely that landlords and letting agents would see it that way as Quest...
For new flats be careful as HMO standards are higher than current building standards.
Especially be wary of double upper flats and flats without carpets.
I think the case in England was some scrounger trying to claim that rent in advance was a deposit and as it had not been protected then they could claim 3 times the unprotected amount back.
theartfullodger,
Apologies you are quite correct it was the Court of Appeal not the Court of Session.
The Court of Session has now confirmed that rent paid in advance is not a deposit.
At the recent SAL conference, T C Young advised landlords that rent paid in advance was illegal in Scotland.

50 quid!! To hear how the loony lefties at Shelter plan to destroy the PRS, no thank you. :(shake):
You would think they would be able to fund it for free seeing as their income in the last set...
I have no problem with landlords having to get EICRs.
I do though think the TIP is bureaucratic and a waste of paper.
It is currently twenty pages and surprisingly all the latest issues such as...
