I'm buying another property to let out, and a few issues have come up in the Homebuyer's Report. This is a leasehold ex-council property so structural issues will be the council's responsibility and I am led to believe that councils as freeholders tend to be fairly proactive about identifying faults (although I realise that I will effectively pay for any resultant repairs through the service charge, at least it means it's not my lookout). So given this, I was wondering, might anyone have any thoughts on how serious any of the following are from my point of view:<br />
<br />
<b>Cavity Wall Tie Failure</b><br />
The report says &quot;I noted that there are hairline cracks running through the mortar joints between the bricks. This can, but does not always, indicate cavity wall tie failure.&quot; Would this be a freeholder responsibility? Either way, is it likely to be a huge cost / cause a big issue?<br />
<br />
<b>Asbestos</b><br />
<br />
The surveyor seems obsessed with asbestos -- there is loads saying that there <i>may</i> be asbestos in a building of this age (it dates from around 1980):<br />
<br />
&quot;Materials containing asbestos are present in many buildings of this age, often enclosed and unexposed. Asbestos may be present in heating installations, to textured ceilings, floor tiles and also in concealed areas as a fire protection. Detailed examination and investigation of all such areas is beyond the scope of this report. The exact nature of thematerial can only be determined by laboratory testing.&quot;<br />
<br />
and later: &quot;the ceilings are generally in a poor condition. Textured ceiling coatings are likely in a property of this age to contain asbestos fibres, although specialist testing will be required to confirm.&quot;<br />
<br />
and again, later: &quot;Asbestos may be present in [the kitchen] floor tiles.&quot;<br />
<br />
and even later &quot;Asbestos may be present in sealants and many other building elements.&quot;<br />
<br />
Are these big risks? I am planning on getting all these things replaced as soon as I complete, so will it just be up to my builder to dispose of these potentially asbestos-ridden items in a safe manner?<br />
<br />

Could I get some advice and feedback from fellow landlords, with regards what boilers would you recommend? I am looking at a condensing combi boiler, and have asked the plumber to quote me for an Ideal Logic+, and then (for comparison) a Worcester Bosch model.  <br />
<br />
Have you had any particularly bad or good experiences with different boiler brands? I am looking for a decent boiler with a reputation for reliability as a first priority, but (despite asking for the Worcester quote) I don't really want to buy a premium product... Happy to go to a mid range price point. <br />

New member here. I am looking into buying a couple of terrace houses at £90,000 approx each and letting out at about £450 pm each. Research of the local market supports these values and these sort of houses do rent fairly easily locally.<br />
<br />
I have £200,000 in the bank so can pay cash for both if needed, but would then have no cash to purchase any additional properties for a long time. <br />
<br />
My question is what is the best way to go about financing these - buy without a mortgage, get rent coming in, then use equity and rental income to fund additional purchases over time, or put down 25% deposits on 2 or 3, and take out mortgages on all properties - and do the same (25% deposits) with more properties over time.<br />
<br />
Ideally I'd like about £3000 pm coming in to not work, so would need long term about 6 of these houses. It's how I make the transition from potentially owning 2 outright with a bit of pocket money from rental income, to owning 6+ with enough coming in to live off without a job. <br />
<br />
Low interest rates and likely high inflation for years to come suggest borrowing is the way to go. <br />
<br />
Any thoughts / comments?</div>

I had a search of the forums and couldn't find a similar solution.<br />
<br />
Essentially, I had an AST which states that we need to give them 30 days notice before moving out. However we want to move out on the last day of the contract. We would be able to give them about 15 days notice but now our LL want to retain our entire deposit because we haven't given them 30 days notice.<br />
<br />
Can they do this? I did a bit of digging and the OFT says that this is an unfair clause (contract was written back in 2010 and never updated since). However I'm aware that OFT doesn't have any legal standing.<br />
<br />
Would our LL be able to do this?<br />
<br />

Cleaning and repairs once they had gone came to about £900, so I thought it would be straightforward to get the £450 deposit money, but as the tenant has failed to respond to the agent, it has dragged on. The deposit is held by MyDeposit,and when I asked them, they gave a time frame of 90 days for a response. So it's now over 100 days, and I contacted the agent this morning to see what will happen and this is the reply.<br />

<br />
My|Deposits only protect the funds for 90 days after the expiry date of the tenancy, which means that after this has expired the tenants can no longer raise a dispute through their adjudication services.<br />
<br />
However, the tenant can still pursue this through the courts for 6 years after the expiry of their tenancy. This is why it is stated that if the tenant does not continue with the services provided by My|Deposits, that you go through the court system as this voids the tenants claim on the deposit completely if the funds are awarded to you.<br />
<br />
My colleague has continued to chase the tenants, but so far, we haven’t had a response.<br />
<br />
I'm not really sure what she is saying.I don't think the tenants will ever respond. Do I have to take legal action to claim this money?</div>

We did not have time for the carpets to be professionally cleaned, so we have given the letting agent the money to get this done.<br />

Our letting agent is now saying she will deduct from our deposit the £60.00 cleaning costs for someone to go in and dust the property. Can she deduct this from our deposit if we have requested to go in and do it and she has refused??</div>

I have 1 tenant who has moved out of the house and said that he would find a replacement for himself and would continue to pay rent in the mean time.  They are now two months behind with their rent with their 12 months due to expire in mid-August.  <br />
<br />
The other 4 tenants have always paid their rent on time and I have no problems with them at all.  I have written to the non-paying student's Guarantor and hope to recover the unpaid rent that way.  What recourse do I have if the Guarantor simply does not get back to me? I'm unsure regarding Section 21/8 as it only applies to 1 in the 5 tenants, plus I don't need to evict the tenant - he has already left.  I don't want the other 4 tenants to suffer for one person's failure to pay.<br />

If anyone could shed any light I'd be most grateful.<br />

 I am now struggling in today’s financial climate to carry on not charging  rent so I am enquiring whether she could get housing benefit and I could charge her rent. She only gets £140 per week pension and a 2 bed house is approx £100 per week. Because we have never claimed any benefits, when perhaps my mother could have years ago, we haven’t a clue whether she is entitled, or the procedure to follow. . If this is possible what order of events do I proceed with before she applies for her benefit?<br />
What do I need to do to satisfy the benefits office ?<br />
Do I now charge her rent before she applies for benefits  ?<br />
Do I take a deposit ?<br />
Get a rent book<br />
Is there any other things I need to do before she applies and what is the procedure ? <br />

Having done some research I understand that the lack of written licence is not a problem, that 'reasonable notice' is not set in stone and will be dependant on behaviour and length of licence, that I do not need a possession order to evict him and I can simply change the locks. <br />

I believe I have been fair and reasonable in the circumstances but I would be grateful for anyone else's thoughts.  I would also like to know if anyone has any experience of how the court would be likely to view this matter (interpretation of reasonable notice and my 'service' of notice to quit by text message) or could point me in the right direction of any relevant case law.  <br />
