View Full Version : Is house still "on market" for HIPS purposes?

Hi, have been marketing my flat since Nov'07 with Tenant in situ, I found a buyer, accepted an offer, and finally got rid of T.

Sadly the Buyer seems to have has dissapeared:(

My question is slightly off topic, but is, as the property has been on the market all the time without a break. I am now thinking of going multi-agency and trying to advertise privately as well.
As the prop has been on market since Nov'07 I have been told I shouldn't need a HIP's pack even if I go with different agents..........
Can anyone confirm this please.

Se my post #3 on "When is HIPS scheme binding" thread. In your case, it seems that your house has been on the market for a few months- so number of bedroms and HIPS start dates (differing dates by reference to that number) will determine whether or not you have to comply.

HiPs for 1/2 bed props started 14/12/07 if I'm right

My prop has been on the market (sole agency) since early Nov '07
therefore I don't need Hips.........fact

My question was, if I now go multiple agency and/or advertise myself, would I need a Hips because I'm advertising with someone new after the Hips deadline date for 1/2 bed props.

Or as it was on the market before 14/12/07 I have satisfied the law and can advertise further with anyone else without Hips

See s.149(3):
"A residential property which has been put on the market is to be regarded as remaining on the market until it is taken off the market or sold."
