I have an awful freeholder.
Some time ago, I wrote a thread about the freeholder breaking tenants belongings stored in a communal store, and threatening the tenants. The police were called, a incident number was given, and the police advised that the tenants should move out. No follow up, or action taken against this madman!
I have one flat within this section 257 HMO. The freeholder refuses to send accounts, deal with anyone in writing, have consultation before any works (whether major or minor), to do urgent repairs. Also, since the 1st Oct, he has failed to put notices with his contact details up, hasn't had any electrical safety checks done, hasn't provided a bin store, fails to maintain the building or communal areas.
Today, I called the local council, to see how they would go about enforcing SI 1903, and they said that they don't have the power to!
We are going down the LVT route,to get a manager appointed, but it is taking time and money. In the meantime we still have this insane halfwit mis-managing the building.
Last year the roof leaked, he refused to deal with it. Another tenant (closer to the roof) called enviromental health. They served notice on the leaseholder, but said that they had no power to serve a notice on the freeholder. The freeholder was not only refusing to repair the roof, but also refusing to allow anyone else access to it. Finally, several solicitors later, and the threat of legal action allowed that leaseholder brief access to have the roof repaired, at their own cost.
Is there anything that can be done about people like this? Why has the new legislation been brought in if no-one can enforce it?
I feel like I am hitting my head against a brick wall, and the building will continue to fall apart until the LVT appoints a new manager.
