I have just served a section 21 notice for the first time, as far as I am aware, the notice is correct but I fully expect the tenant to delay as long as possible. The tenancy was originally an AST and is now periodic. I have obtained forms N5B from the local county court in readiness and will send these off the day after the notice expires if necessary. I am told that, locally, I can expect a 4 week delay for the hearing. If the hearing goes in my favour, how much time will be given to the tenant to leave, also, what delaying tactics can I expect from the tenant and how do I get round them?
If it is any help, I can show a history of late and non payment of rent, also (they are a family with school age children), that there are a number of properties available locally, same number of bedrooms and some at lower rent.
