View Full Version : New tenant - Travel documents, no UK passport

Could anyone advice on assigning a lease over to a new tenant who does not hold a UK Passport but has a Travel doument for the UK?

It has a home office ref number and states "there is at present no time limit on the holders stay in the UK"

I understand this to read that the government have left an option where this person could be removed from the country, probably an extreame case but don't want to assign a 15 or 20 year lease to someone in that situation?

I presume your existing tenant is proposing to assign to this foreign national?
As a landlord you have a right to object to an assignemnt providing your grounds are reasonable, eg the tenant is not suitable, or the use is inappropriate etc.
However, you cannot delay the assignment unreasonably, and if you do you risk having to pay compensation to your tenant.
This is a rather specialised case, but one that perhaps will become more common in future.
I suggest you seek advice form the Home Office and your solicitor, who no doubt will be involved anyway, with the assignment.
