View Full Version : Can owner of unregistered land let it out?

If a property is unregistered with the land registry, is the landlord/ owner entitled to rent out the property. I have no futher info as to how or why at present but wondered if anyone knew of any regulations. Or if there were any implications. The property has been rented out for many years with the same owners, this has just become apparent now?
Any ideas?

If it is unregistered with the land registry, has the tennent got any claims over the property, and is the owner definately the owner? sorry I am no help but I'm sure there are companies that check the land registry against empty properties for some local authorities, it may help to search google and email them for advice, sorry I couldn't be of any more help

It may or may not have an issue . However, there is the issue of after 10-12 years, the tenants may be able to make a legitimate claim on the property!

Whoa! Just because property/land is unregistered with the Land Registry does NOT mean that the title is illegally held by the owner. Stop trying to pull the rug from under this landlord. You won't succeed.

I hope you werent referring to me there poppy....as if you are resident in a property that is not registered for around 10 years, you CAN legitimately make a claim. That is the law. That is not to say that you will succeed in that claim....new laws make this less likely.

I think you are confusing Adverse Possession it has nothing to do with the land being registered.
If someone was occupying someone else's land (as a trespasser) whether its registered or unregistered you can make a claim for adverse Possession (after 10 years for registered land and 12 years for unregistered land) but not if you are there with permission.
This right is transferable even saleable and successive periods of occupation by different persons will count towards the total period of occupation.
What is the actual purpose of the original question. I am not sure I see what relevance a property being registered with the Land Registry has to do with a tenancy?
Why not ask the Landlord to supply proof of ownership. If he can not supply it then any tenancy agreement that has been signed will be in doubt.
What is the outcome that you want from this issue?

Yes, what is the TRUE purpose of your question lucid?
On a different angle mjpl, no tenant let alone letting agent has ever asked for proof of ownership of my properties.

hi thanks for the response, I was just trying to find out if there were any issues with the landlord having rented out the property for many years being unregistered and if it invalidated any current tenancy agreements. The landlord is now selling the property with existing tenants, am I correct in assuming they would have to register the freehold before signing the contract of sale?
