I posted on the old forum that I would get back to everyone on the question of deposits where its status is silent in an AST - i.e. it doesn't say whether held as "stakeholder" or "landlord's agent".
I have received interesting legal opinion on this but would like anyone who posts regularly to think on this one. Please - I don't want your opinion as to what you would want to happen to the deposit in the event of a dispute but what the lawful interpretation might be. Think about it before you answer but I would certainly welcome opinions.
Remember the new Housing Act will automatically require all deposits to be held as "stakeholders" so it will only affect AST's written before the new tenant deposit scheme comes into force.
I will post my thoughts in due course but would like anyone to post their reasoned arguments in the meantime. :confused:
