Hello,

As mentioned in an earlier thread, we have recently moved out of our flat.

We paid a full month's council tax for July when we only stayed for six days during that month.

We are after a refund for the remaining part of the month.

The council have not given any indication when they will refund the difference. They say they actually have a backlog...

Does anyone know how long it is before a refund is issued?

How long should I be prepared to wait?

Once the property is empty (of possessions as well as people), you are entitled to a refund for up to six months of void. There is no hard-and-fast rule re timescale.
Allowing local authority about a month leeway, which is now up (6 August), send a formal warning letter (your own or a solicitor's) threatening proceedings unless you receive a refund within fourteen working days.

do such proceedings take place in a small claims court?
i need to know for when i write my letter.

Yes, assuming that the debt would be within its jurisdiction limits- no, sorry, but I don't know what they are currently.
