View Full Version : Notice needed from tenant on Periodic Tenancy
Hi all. I have a tenant who is now on a Statutory Periodic Tenancy. I know that to terminate I have to give 2 months notice, which must end on a tenancy period end day. I also know that the tenant has to give 1 months notice if he wishes to leave. My question is this - does the tenant's notice have to end on a period end day? Thank you in advance for your help.

I do not believe that the same requirements apply to the tenant. Obviously you will have to compute the correct amount of rental due if the tenant vacates the property on a day which is not a rental period day, nevertheless, he can go when he wants to. The reason the two months notice you have to give him is so exact in its expiry day is that it is a requirement of the 1988 act if you serve notice under section 21 and subsequently need to apply to the county court to obtain a possession order.

P Pilcher - the tenant has to give one month's notice and it still
has to end on a rent day as both sides have now contracted to a rental period now its periodic. :rolleyes:
