View Full Version : Tenancy agreement query

Hi,

I have a tenant in my flat. She has been my tenant, with no problems, for about 2 years. Lst week she called and she wants to change the name on the tenancy agreement to her sisters name. Her sister is terminally ill and needs the name on the agreement to get benefit from rent.

After the change both my tenant and sister will be residing in the property.

My questions:

Is there such a thing as a transfer of name, or do I just rescind the current agreement with my tenant and create a new one with the sister?

What happens if(when) the sister dies and her name is on the tenancy agreement, but the (now ex) tenant is residing in the property also? Would this give her some sort of legal hold on the property?

Any advice MUCH appreciated.

You can't "change" the name of tenants on an AST
Draw up a new AST agreement with both sisters' names on it.
If/when one dies the other will automatically inherit the tenancy.

do I not need to officially "end" the current ast?

You can draw up a new agreement at anytime providing all parties agree. this automatically voids a current one.
You only have to serve notice i.e. S21 if the tenant doesn't want to play ball.
