View Full Version : Can I terminate my two-year lease?

I have been renting an office since march 2003, on a two year contract. However, due to repair work being done in one of the rooms, I was unable to sign the contract until work was complete, Novemer 2003. I want to get out of the office now. Does anyone know Am I tied into the two year contract until November? Also I have been trying to sub let the office and have to pay th eingoing tenants legal fees in advance, according to the landlords agent, I have just had tenants poull out for the 2nd tiem at my expense, can I recoup any of the costs, assuming the ingoing solicitors have not completed all work that was paid in advance for? any advice would be appreciated.

This all boils down to the terms of your agrement, which I assume will be a legally binding contract - this means you are committed to pay for the period contracted for and bound by all its terms.
When you say you are trying to sub-let (I assume with consent from your landlord) do you really mean you are assigning the agreement to someone else? If you were to sub-let you would remain as landlord to your own tenants?
I don't know why you have paid legal fees in advance for your prospective tenants (assignees?) as it's usual for the ingoing tenants to pay at least their own fees?
This is really their first test of commitment, so it's no wonder they pull out willy nilly?
If you really insist on doing it this way, why not agree they pay if they pull out?
Any repayments is now going to be a matter of negotiation.

Yeah, I would suggest you go through your own contract with a fine toothcomb to see what you are liable to pay. If you are now in a legally binding contract for a two year lease and your two years are not yet you'll be contracted until then.
