i read somewhere thats there a certain council/borough that is not enforcing the wash hand basin rule for 5+ residents in HMO's now and are waiting for 3 years hoping that the government will see sense to this stupid rule. I think it was in the forum somewhere, could somebody give me the link to that thread or the article within that thread.

Just last week a city council told me that though they had no power to ignore the rules regarding WHB's, they did not see the point in some properties, and in those cases were giving landlords 4 or more years to comply, in the expectation that the rules might well change. I suggest you ask yours.

I know that Sheffield are allowing up to 5 years in the hope that the govt will reverse the decision on WHB's.
I don't know of an authority which is not enforcing it, but if they are they may be doing it on the basis that "unit of accommodation" is not defined in the Act as a bedroom, so they are choosing to define the whole house as the "unit of accommodation" (http://www.cieh.org/ehp/ask_the_professional/articles/getting_ready_for_the_rush.htm). This is probably wishful thinking given the ODPM guidance which uses the term "sleeping room" rather than "unit of accommodation" (http://www.communities.gov.uk/pub/316/HousingAct2004ImplementationLettertoStakeholders_i d1165316.pdf).
