Possession granted

Hi Folks,

We have been granted possession by ways of a s21 notice by the courts for one of our flats. The tenant owes over £8k and we have a feeling that she wont leave after the 14 days.

We had also applied to the courts after a s8 notice expired however the court date is now of the 30th January 2012

Can we proceed to court even though we have been granted possession already with the s21. We would like to recover the money also

Yes, once the tenant departs, write to the court manager and advise him/her that the tenant has left the property but you would like the claim to continue in respect of unpaid rent.

If tenant hasn't left by the hearing date (the bailiffs aren't always quick) then advise the judge at the hearing that you already have an order for possession and that you just need an order for the unpaid rent.
