There is a potential problem for tenants who pay rent before it is due which had not previously occurred to me. Any tenant required to pay more than one instalment of rent in advance as a condition of being granted a tenancy should ensure that the agreement provides accordingly, that is for the amount of rent he is paying to be due immediately and expressed to be for the relevant period. Where the rent is paid for the whole of the fixed term agreed that would of course result in the periods of any SPT being equal to the fixed term, which neither landlord nor tenant is likely to want. Accordingly, if six months' rent is to be paid the term should be at least seven months with a provision for the last month's rent to be paid at the beginning of the seventh month.
