Deposit protection for a deposit from several years ago?

We've been renting a cottage (the OH has been here several years, I move din in 2010). She paid a deposit back then, and unless I'm mistaken, they didn't have to be protected back then.

Once the law changed to get landlords to protect deposits, did they need to put it in a scheme?

I don't think they did and I just want to be sure of the facts, for if they turn round and deduct anything that I don't think is fair.

IF a new contract has been commenced since 6/4/2007 then the deposit needs to be protected. If, on the other hand, she is still on the same agreement from when she movedin, then deposit protection isn't an issue.

TBH, in practical terms it makes very little difference.
