Could a three storey house containing one tenant (all on their own!) using a bathroom and toilet, separate from their living space, ever be considered as an HMO? Also, if the owner moved in as a resident landlord, and used the same bathroom and toilet, could this be an HMO?

No, HA004, schedule 14 applies.

Thanks for that. Searched for this and eventually found it at http://www.opsi.gov.uk/ACTS/acts2004/40034-at.htm#sch14 and both scenarios appear to be covered here.

I understand that the Housing act with respect to HMOs will be changing soon, do you know when this is due to happen and if the above scenarios are likely to be affected?

Parts of the HA2004 dealing with HMO's came into force on the 6th April this year.
