hi -i'm new to this forum . my tenant (12 months)is on a short term assured tennancy and i wish to increase the rent by £10 p.c.m do i just write her a letter stating when the increase takes effect or do i need to draw up a new tennancy agreement

edit-she is now on a periodic tenancy

I've alreay posted so much on this I don't want to repeat myself. Just use the search facility and use keywords to find what you need. Start with "rent increase". :rolleyes:

Thank you Paul F. I now have form section 13(2) to send to my tenant . Her tenancy commenced on June 17 2004 - should the increase take effect from June 17 or July 17 2005?

I assume that your current fixed term expires at the end of June 16th. Provided one month's notice is given to the tenant, the increase can take place on the 17th. June. You then cannot increase the rent again for 12 months. Of course you could ask the tenant to accept a new AST for 6 or twelve months at a new rent when the current one expires. Then there can be no appeal against the increase - the tenant either accepts it or moves on.

David. You probably haven't read everything on this.

There's no need to issue a S13 (b) notice if there is already a provision within your existing AST to increase the rent - you can just give your tenant reasonable notice of 2 months or more. If not issue a S.21 then invite your tenant to apply for a new tenancy and offer her one at the increased rent. Remember a S.21 must be without reservation, so don't talk about offering her a new tenancy, just say if she wants a new one you will strongly consider it.

I suggest you go back and have a look at a lot more of my posts.

Paul - you mention "existing AST". My tenant had a 6 month AST beginning June 17 2004 but that obviously ended in Dec.2004 when unless indicated otherwise it became a periodic tenancy( am I correct?)
I am not familiar with S.21

Any landlord not knowing what a S.21 notice is really going to struggle. Just put "S.21" in its various formats into the search facility and just see what happens!!!!

This is the most basic of notices to end a tenancy agreement and you need to know all about it.
