View Full Version : compensation from an insurance company-advice needed

I own several ex local auth flats

Attempted to make a claim over year ago for damage to my flat by contractors of council

In order to claim I first had to submit an application to insurers agent in local authority
This agent is employed by local authority yet all claims must go through his office -and-be approved by him

Over past 12 months he refuses to respond to any request
He has not forwarded on my claim to insurers
He will not reply to my emailed/written requests to either pass on -or- return to me

I have been pressing insurer to deal with both claim and their agent-obtain claim plus evidence from agent and respond

They tell me they do not have to reply to me as-since they do not have claim physically-there is no claim!!

My knowledge of law of agent is weak

What is my position here

Thought of sueing insurer through small claims court as this is their agent
They are therefore responsible
Either accept or rebuff claim
Return my original docs
Failing which I seek compensation through small claims court for loss of original doc-invoices,surveyor report,film etc

Is there no insurance ombudsman for commercial insurers?

Who can I complain to -not FOS/FSA I checked

What is my legal case for compensation -does it have merit

What would you try?

Just to update on this

After a complaint to FSA
They persuaded the block insurer to pay claim-without any form of documentation

I am now attempting to persuade LGO to look into practices by LA (hammersmith & Fulham) in handling claims

Seems to me they use all meants to deny a claim going forward

I have also waited over a year for return of original documents

My advice-for what its worth

If your "block" insurer tells you your claim is "out of time" dont accept this!

I would get an Insurance Company Loss Assessor to make your claim more professional. Presumably you have all the repair bills documented. Why not go to the small claims court and submit a claim. Yes I know that if forinstance you are in Turo you are going in front of Turo magistrates, some of whome may be Turo councillors, but as your claim will be addressed to the Town Clerk it will rattle their cage from the top down.
