Hi all, I am currently looking at a property that is two flats. One flat is vacant and the other has a sitting tenant.
The two flats are sold together but my problem is that they have one combined set of deeds for the two flats (this is why they are being sold together), so basically i am just enquiring whether it is possible to seperate these once i have bought them, which would mean i would then be able to sell them seperately and they would also be classed as two flats??

the house, comprising 2 flats, is probably being sold as a freehold. I assume that you would simply be able to carve 2 leasehold interests out of that freehold leaving

1. a frehhold ground rent
2 2 x leasehold flats let sold on long leases

You'll definitely be able to split them in some way. As propman says, you could either create 2 x 999yr leases out of the freehold (which then effectively become freehold with normally a peppercorn rent) or simply split the freehold in two and have two new freehold titles.

Speak to a local solicitor/conveyancer and they could advise.

Also if you are intending after conversion to remortgage the properties on a buy to let basis be warned that some lenders dont lend on freehold flats.
