We served notice on a tenant re anti social behaviour. Last night there was a fire at the property and the tenants can no longer live there, they are claiming there was an electrical fault, the fire brigade say otherwise, we are awaiting a copy of the fire report to prove it was not down to us. We are now left with a few issues!

1) We need to secure the property but do not know where the tenants are and have no way of contacting them. If we secure it and leave a note on all doors and windows as to where they can contact us is that sufficient.

2) the tenants are demanding money for their possesions etc as are the people next door who were best buddies with the tenants.

3) Are we obliged to rehouse the tenanst baring in mind they had been served notice which has now expired.

3) Are we obliged to rehouse the tenanst bearing in mind they had been served notice which has now expired. The serving of a notice for anti-social behaviour could be any Ground from 12-16 of S.8 but as they are discretionary a court must decide on whether possession will be granted; or are you saying you have a court possession order for which the date of possession has expired - you don't make this very clear?

Thank you Paul, on point 2 that was our thoughts too! on point 3, we siiued a section 8 based on grounds 10 11 and 14 but as yet had not applied for court action, we were waiting to see if the section 8 was enough to quiet them and for a time it was! We think our insurance covers us for re housing the tenants in the event of a fire but we have nowhere available and we do not want to inflict this family on anyone else. these people have now taken to calling and demanding money and threatening to sue! We are currently logging all calls and may well report them for harrassement. They are knonw to the Police and along with other residents of the street are not well liked in the area!

Do we still need to evict them? and what do we do in the meantime?
