View Full Version : Flats on top of commercial: HMO?

Hi I havetwo just purchased a commercial property with a A/2 and A/3 Licence with a three studio flats above, its ground plus two storeys.
The down stairs is a restaurant and an office which are let and the three flats are let to individual tenants.
Kindly advice if I would need a HMO Licence

Im thinking no as i believe the commercial properties (restaurant and offices) to fall outside of HMO licensing. If the studio flats are self contained then i would also think no as there is no shared facilities. Ie shared toilets, kitchens etc.
You are right in thinking along those lines though especially with three floors. With such a big investment i would definitely visit the council and see what they say otherwise your insurance may be invalid or you could be open to prosecution if something bad happens.
I hope someone with more knowledge comes along and puts us right on the subject. Sorry couldn't be more helpful.
I may be vague but if it starts you off in the right direction then we are on a winner.
