View Full Version : tannant dictating that front garden be overgrown

i own one flat in a block of 4. the landowner has the other three. a couple of years ago he let the basement flat to a person in need of housing. this person seems to have some sort of psyciatric problem as they have since insisted that only they can do the gardens. for the past year this means that the front garden is completetley overgrown with blackberry bushes. they spill out onto the street and block a pathway down the side of the front garden. any attempt by me to sugest that it be cut back is met with abuse. i have spoken to the landlord and asked him to get it fixed but he does not do anything. recently the nutter has tied a thick cable around my gas pipe so that he can completetly enclosr his basement flast in these plants. he will not remove this and i spoke to the gas people and they said they cannot do anything until the pipe breaks.

also the nutter is training the blackberies up our front stairs. the stairs are used solely by the top 3 flats as the only entrance. when i have cut them back before so i could reach the handrail the netter tells my husband never to touch them again.

i do not know what to do as not only is it devaluing our flat but it is very difficult to get up and down the stairs in wet weather.

can the nutter get the police onto me forr cutting a path thru to the front door?

Bleach won't do it. Weedkiller will though. Might be a bit more expensive but definitely more effective. Like the 2am bit... :D

i often think about using weed killer but won't this be criminal damage?

the covenants in the lease do state that the gardens and common areas must be kept in a neat and tidy state and no obstructions are allowed.

You have an equal right along with your errant neighbour to pass uninterrupted to and from your property. You therefore also have the right to crop the plants (not uproot) if they are causing an obstruction or nuisance.

To cover your arse, I suggest that you write a letter addressed to the freeholder (with a copy to the errant neighbour) asking him to crop the plants within 7 days or you will crop the plants yourself without any further notice. Try and find a conciliatory way of wording this to keep things amicable.

Ensure that you dispose of the garden waste responsibly and promptly using the facilities provided by your local authority.
