Agent with holding my rent!

Wonder if anyone can help, my agent withheld my final rental payment by 16 days, in the contract they state that they will pay the rent within 9 days of receiving it from the tenant.

They said that as it was the final rental payment they had with held it in case of any maintenance problems and to ensure they had adequate funds!

The also stated that the final rental payment was taken from the tenants Security Deposit!

What are my rights?

Depends upon the terms of business you have with them, pure and simple. But, generally speaking, you are fully entitled to that rent...if you have common ToB.

So I have good grounds to sue the agent?

And is it worth it?
