Hi

i am currently evicting a tenant through the courts as she had not paid any rent for the last 3 months.

However my solictor has told they have had to contact my mortgage company to get a letter confirming i have a mortgage.

The problem begins is i did not notify the mortgage company that i was going to move back to my parents (due to their ill health) for a few months to look after my mum. I put this tenant in whilst i was at my parents.

I am not sure what is going to happen with the mortgage company. Can they take me to court as i breach my mortgage agreement? i am really scared .

I think you ought to write to the mortgage co. as soon as possible and explain that you are moving in with your mum for a while and plan to let the property with their permission in the meantime, this way at least they have a record of you advising them that you will be letting.

It might be an idea to ask the solicitor exactly what they need from the mortgage company and how they worded the letter they sent.

Obviously I am not a solicitor, so please do not take my advice as legal advice of any sort. You may be better off being upfront with your solicitor and getting advice from them.

Good luck.
