View Full Version : LLord wants to see references from Agent
Hi
I recently rented a 3 bedroom house to 3 working professionals (brother and 2 sisters) in the capacity of an agent.
I obtained 3 credit checks, 3 work references and previous landlord references, along with the usual photo id copies.
Tenants have moved in all went ok at check in, when leaving property, landlord requested I give him copies of all references and paperwork involved in the setup of the tenancy.
Am I obliged to supply this information, being the LL agent or would it fall under Data Protection ?
Anyone have any ideas, I have no problems supply info but don't want to infinge DP laws.
Many Thanks
Shaf

You are L's agent, aren't you? So whatever you do, you do it for L! Yes, L can insist; no, you can't refuse.

Your question and quandary clearly demonstrates that you are in doubt as to whom you work for.
You do not exist as an agent without income from landlords, unless you own your own properties and let those out.
There is no data protection act to concern yourself with in this part of your capacity.
The landlord is entitled to know who is wanting to or who has lived in their property.
Granted, the landlord should have asked you a long time ago for the documentation, but why are you not, as a matter of normal business practice, supplying this documentation to your client automatically?
By all means retain a copy in your systems for easier admin, but the information in the documentation belongs to your client and not you or your agency.

Aha- we agree on something (at last).
