Hello,

I was wondering if someone could help me! I have a 3 storey house. I have 3 seperate tenancy agreements i.e. one for the loft - single occupancy (own bathroom and kitchenette), one for middle floor - couple (own bathroom, kitchen, living room and bedroom) and one for ground floor - couple (own bathroom, kitchen, bedroom and living room). There is one main communal door. there are also 3 seperate council taxes for the 3 'housholds'. None of the households share any facilities. Would this be an HMO? Im so confused by it all!

So the property is 3 self contained flats and presumably its a converted building?

If it is a converted building and the building was converted into the 3 self contained flats without complying to the 1991 Building Regulations, then yes it is most probably a HMO, if it complies with standards required bythe 1991 building regulations then it wouldn't be a HMO.

thank you for reply. They are not officially self contained flats. They are not split so as to have individual front doors and they do not have 3 seperate addressed (e.g. flat 1, 2, 3 etc), i.e. loft person has to go through middle corridor to access loft room. The council did come and inspect the property in 2008 when they deemed that it should have 3 seperate council taxes (originally it had one council tax), would they not have assessed for HMO status then?
