View Full Version : Claiming on freeholder's building insurance

I recently bought a leasehold property and had a leak yesterday due to a defective saniflo pump in the bathroom. We called out the plumber who repaired the problem but he had to smash open the tiled wall to get to the pump as there was no point of access!!

We haven't contacted the freeholder (a property development company) yet but spoke to their insurance company to make a general enquiry. The insurer advised that their buildings insurance would not cover the repair in this type of case because this scenario is regarded as "wear and tear".

Has anyone had a similar experience? I'm wondering whether it would still be worth pursuing this with the freeholder?

You have the right to see a summary of the insurance and the policy under section 30 a of the landlord and tenant act 1985, if they wont let you have one to see the exact wording.

Saniflow: unless this stopped working as a result of an insured peril it is unliklely to be covered. eg your car insurer wont replace your blown tyre, but will if it is damaged in an accident.

Access; If the opening up works are included in trace and access, or were dmaamged from a leak from the saniflow these may be covered, subject to any excess on the policy.

Never ever cover up pumps valves or drains without an inspection plate or hatch!
