Letting has run for over 7yrs; who's liable for safety checks?

Hello,

I have a query hope someone can help.

I let a property through managing agents, haveing done so since summer of 2002. I let to them and they sub-let it. They have not yet asked me to carry out the latest gas/electricity checks. Does this mean that as my agreement with them is now over 7 years they are responsible for these or should i chase up and ensure they are done.

Any advise appreciated

If you truly let to Agents:
a. the letting is not a residential let at all (as the Agents do not reside there, do they?); but
b. s.11 of LTA 1985 will nevertheless still apply (as the letting is 'a lease of a dwellinghouse', the requirement of s.13).

Result: you as L are inescapably liable for repairs unless the letting was originally granted for > 7yrs. [see s.13(1)].

looking at the act now to see what it means. Accidental LL due to circumstances at the time and now live some distance away.
