Hi i have an on going problem with a rental agency for a house this is the list of ongoing problems and issues we have had it got so bad we moved out after speaking to enviromental health please see below.

I Just wanted to list all the problems and the reasoning of wanting an early release from the property.



As you can see it is issue after issue on this house and now the bidet leaking it’s just not on. Also when I moved in grace had a massive list of jobs that were going to get done and only a few of them ever did.



I know its an old property and things do go wrong with them but this is one thing after another and nothing ever gets fixed in a timely manor if at all.



You keep mentioning the Moving in Date this was set by yourselves as i was originally told Saturday then told it was Wednesday five days before and agency are always complaining at the time restraints on moving in when they set the dates.



As you can see this is no reason or excuse for work not to be done!



Here is a list of what i can think of that has happened so far in the 3 months i have been in the house.



You have a copy of this informataion already as i have retrived all the information from previous emails with yourself.



Bathroom Taps reported on the 26th November Still not working.

Builders rubble left in garden 1st December has been removed after 2 weeks of chasing.

Consumer unit was promised as soon as I moved in was done in Jan.

House was filthy when I moved in cleaner was sent round but did nothing reported on the 4th December

Broken window in master bedroom fixed after 1 month of it been stuck open by 3 inches!

Broken window pane in master bedroom still broke reported 2nd feb .

Leak through the ceiling on 2nd floor guy came round but not rectified as he couldn’t find anything the matter with it.

Blocked drain took over a week and a visit from Sharon too take a photo of the blocked drain but a plumber was sent round!!

Leaking bidet- This is a major concern as the plumber has mentioned replacing the roof of the utility room does this mean it could collapse?? If so this needs to be made safe asap.

Hot Water- The hot water coming out of the taps is so hot you cannot put your hand under it, This water is pretty much boiling and is dangerous especially to children.



I have spoke to my solicitor and from what i have mentioned she believes the landlady to be in breach of contract according to the following:



The Landlord and Tenant Act 1985 Section 11

(b) to keep in repair and proper working order the installations in the dwellinghouse for the supply of water, gas and electricity and for sanitation (including basins, sinks, baths and sanitary conveniences, but not other fixtures, fittings and appliances for making use of the supply of water, gas or electricity).



IB) Nothing in subsection (1A) shall be construed as requiring the lessor to carry out any works or repairs unless the disrepair (or failure to maintain in working order) is such as to affect the lessee's enjoyment of the dwelling-house or of any common parts, as defined in section 60(1) of the Landlord and Tenant Act 1987, which the lessee, as such, is entitled to use.



Also the Landlord has a responsibility of care for the tenant this is not happening.



The house is becoming unsafe and the hot water and leak is the icing on the cake really.



I have asked many times over the last week what is going on with the property but have got nowhere with you.



The house will be empty from the 1st of April as the property is becoming a liability.



I have been more than fair on this and have givern you plenty of notice on my intentions so if ll wishes to re-rent then it needs to be put back on the market now as it is your duty to mitigate my costs.



Also you should have served notice on the landlord on my behalf if you have failed to do so LLplease take this as official notice but back dated too last tuesday as this is when i first spoke to agency.

We had to move out of the property due to all the above issues as it was not safe for children and the work was just not been done.

I stopped the rent when moving out in the hope it would force the work to be done and then move back in this has not happened yet.

The house is at end of contract this week and now the agency have summoned me for none payment of rent saying they have contacted me many times for this over the last few months but it was the first letter we had recived from them.

Please help on the best course of action.

You are much more likely to get a useful reply if you BRIEFLY in your own words and summarise the problems you have had and ask some clear questions about the advice/information you are seeking.

This reads like a chunk from 'Finnegan's Wake;, to be honest.
