ive been having a look at the C class for planning

can someone tell me if a planning application is required for the classes below:

c(3)b - up to 6 people living together as a single household and receiving care ie.supported hosuing schemes such as those for mental health problems or learning disabilities

c(3)c - allows for groups of people (up to 6) living together as a single household. This allows for those groups that do not fall under the c4 definition, but which fell within the previous c3 class to be provided for ie.a small religious communitymay fall into this section

i know for c4 you definitely need planning, not sure about the above two tho

i would be pleased to hear from people running some of these places and any advice i should be aware of if i were to proceed in this route

Morning,

Under the provisions of the Town and Country Planning (Use Classes) Order 1987 and Town and Country Planning (General Permitted Development) Order 1995 and their subsequent amendments, generally speaking planning permission is not required for a change within the same use class. i.e. A1 to another A1 use, or C3 to another C3 use.

Planning permission would however be required for a change from C3 to C4 use.

You obviously need to consider the implications of the HMO definition etc to work out to which class the change of use would amount.

This is just advice and guidance, should you progress then I would recommend commissioning a consultant or taking advice from the Local Planning Authority in writing.

mk, just going through some old LL threads

this seems an interesting one relating to whether i need permission to convert my one bed to a 2 bed

therefore is it safe to assume that planing isnt necessary for this as it would stay within the same class?

You wouldn't need to apply for consent for change of use because the use isn't changing. That's not to say you don't need planning consent.

But the use may indeed change - e.g if the property is rented out to two or more unrelated sharers rather than to one person or a family.

Not for what they are proposing - stated on another thread - HMO wouldn't come into it.

could anyone else shed some light on this?

i plan to add one partition in the bedroom to make it a 2 bed instead of 1

i plan to rent it out to one family, so change of use isnt required

would planning consent be required for this?

Not for what they are proposing - stated on another thread - HMO wouldn't come into it.

It is perhaps unwise to assume that LLZ members can remember the substantive content of all the different threads you start. We have many talents, but unfortunately we are do not possess psychic powers!
