hi

i own a first floor flat

i am trying to buy the ground floor leasehold flat

i have found out that the freehold is owned my someone else

does this mean the freeholder owns the garden? therefore i cannot apply for planning to extend without their permission?

Freeholder would own the garden, but may be willing to allow you to extend the property - for a considerable fee. If your purchase of the new flat gave you a lease on all the flats, you might be better trying to buy the freehold off the current freeholder.

The ground floor leaseholder may own the garden or he may not, you need to find out. Even if the garden comes with the flat, you'll still need the freeholder's permission to make alterations.

Ask your solicitor. It's no good guessing/assuming/crossing fingers.
