View Full Version : Claiming back fees from Letting Agent

I know I read a thread from someone recently who successfully claimed back all the fees they had paid to their Letting Agents but I can't find it anywhere. Can someone point me in the right direction as I cannot find details of which organisation they used to successfully reclaim the fees etc.

Presumably Her Majesty's County Court, with a claim issued on form N1 or via MCOL (https://www.moneyclaim.gov.uk/csmco2/index.jsp).

Thanks, but it wasn't via the Courts it was via some sort of Ombudsman for Letting Agents. The Landlord in question got back all the fees they had paid to the Letting Agent because of their negligence.

I'm not having a very good time with MCOL at the moment in claiming the outstanding rent my previous tenants owe me. After getting a judgement for them to pay me the whole amount, I then get a one liner from the Courts returning all my papers which makes absolutely no sense. The tenants have now skipped owing 4 months rent and I am at a loss at how to track them down or get MCOL to explain what they mean in their letter. I've tried ringing them but even the people who answer the phone don't know what the letter means! Hence I would prefer to go a different way if at all possible.

Was it a default judgment? What does the letter say?

Try a tracing agent; I believe it costs around £75 and many firms offer a no-find-no-fee deal.

The tenant did not return their defence in time and I began the process of requesting the judgement but the MCOL requested £100. I wanted to check my bank account and did not go further. The next day the tenants defence arrived offering £100 per month and the forms stated that I could no longer use the online route to deal with the claim. I asked for the monies to be paid via an attachment of earnings but then got all the paperwork back including the tenants defence stating "The Judgement agreed on 11th March stands" with no explanation whatsoever.

I know roughly what it means but can't get the Court to explain what they want me to do with the paperwork. As I said, the tenant has now skipped and I have no way of contacting them unless I sit outside their place of work and follow them home!

I have written to the Estate Agents setting out all areas I was unhappy with, the incorrect advice regarding a Section 21(4) and basically asking for my monies back. I am sure they will say no but at least I now know the next steps to take to try and ensure that no one has such a poor service from them again. Maybe I should point them in the direction of this Forum!
