on sunday the water was turned off due to water company. the upstairs tenant went to run a bath only to discover there was no water, but left the tap in a on position so when the water did come back on my flat below hers was flooded. i had to get the fireman to climb in upstairs as tenants were out to turn off the tap. my flat was supplied to me by housing association and although they have helped by supplying me with a dehumdifier they will not help regarding carpets which is fair enough as it wasn't there fault. i have contacted the landlord who owns the flat above regarding my damaged carpets and they have turned round saying nothing to do with them as it was the tenants fault. so spoke to the tenant today who has no contents insurance nor me who is saying unless i have insurance there is nothing that can be done. please help as i my carpets need to be replaced and why should i have to pay for them myself? when it was obviously the tenants upstairs negligence. can i take them to court as they are saying i will not have a foot to stand on please please help?
