View Full Version : are electric boilers and plumbing landlords responsibility?

My Landlord has never sought to service our electric boiler which leeks profusely. The boiler is sending most of our hot water out from the overflow and costing us dearly.
My Landlord is aware of this, but when asked to fix the problem, only replies by suggesting we fix it ourselves or leave the property if we cannot make it satisfactory.


Question. if the Tenancy is only an Oral Assured Tenancy, is there still a mandatory obligation to repair the boiler and plumbing within the property?

Whether it's oral or written makes no difference. Do an LZ search on section 11 of Landlord and Tenant Act 1985 re L's responsibilities.

Also look up the correct procedure to use "set off" where you pay for the repairs and deduct the cost from the rent. Did you pay a deposit? if so when did you move in?

Yes. Landlord prefers to ignore guidelines and adapt them accordingly.
Landlord believes that without written contract, he is under no obligations and therefore Tenant has few rights.

Non legal advice - sounds like the thermostat has gone and its just continuously heating more and more water, sending it down the overflow. If it's just that it shouldn't be an expensive repair.
