Hi,
I have a problem and need some advice from the knowledgeable folk on this forum.
In July ’09 I got a contract to work in the Midlands and with work being the way is at the moment I couldn’t turn it down. One slight snag is that my house is in Southampton and the commute would kill me.
I thought I could save myself some serious motorway miles by (a) renting out my house and (b) renting a room nearer work.
I sought advice from the nice man at the local letting agent and he reassured me that I could leave it in his capable hands.
On the first of August I got an email letting me know that he’d found some suitable tenants and they were keen to move in asap. However due to time constraints I couldn’t get down the office to sign the contract and he signed it on my behalf. The contract stated that the deposit would be held in the MyDeposit scheme.
Since August everything has gone swimmingly well, the rent has been paid on time each month and the tenants seem to want to stay. However I’ve just found out that the Letting Agent failed to secure the deposit in any deposit scheme.
Now I’m not only disappointed in the Agent for putting me in a legally uncomfortable position but also in myself for not actually checking everything as I should have done within the 14 day limit.
I have yet to visit the agent and discuss this, I should be able to get time off work this weekend and make the trip down to see him. But I’m confused as to my options, as having spoken to myDeposits the tenancy is now over the fixed date and they are unwilling to take the deposit.
Is there any way I can have the Agent secure the deposit in a suitable scheme so late in the tenancy or failing that is there anyway can I do it?
