I am renting a house in England and have discovered that the LLs have not had the GSC carried out annually. I moved in to the property in Oct 07. I asked them in Nov 08 if they had had the GSC carried out in Oct and they said that they did. I'd been on holiday so assumed that they had just gone ahead and had this done in my absence. We have an amicable relationship and I had always said that they could enter if they needed to do essential/emergency work but were unable to contact me so assumed this had been the case. I asked again in Oct 09 if the GSC had been carried out and discovered that the LLs thought that they only had to have this done when tenants moved in. I said that I was pretty sure this had to be done annually and said that I would be grateful if they could arrange to do this as soon as possible. I don't want to fall out with my LLs over this but I've reminded they 3 times that the GSC needs to be done as a priority and I'm still waiting for action half way through February 2010.

I really just want to double-check with this forum if I am correct in my belief that it is the LLs legal responsibility to have a GSC carried out annually and if there are any real repercussions for LLs who ignore this. I really just want it done so that I know I am safe in my home. I don't want to report my LL or cause trouble but I'm not sure what else I can do to resolve this as they are giving me the impression that I am asking for a huge favour!

Grateful for advice on how I should proceed.

You'd be perfectly within your rights to report them to Environemntal Health, and they could end up being fined. Or worse if anything happened to you as a result of their failure to act.

You want to stay on good terms, and the LL sounds reasonable if misguided, so hopefully if you politely email them the link citing the relevant legislation that will be all that's needed to make them play ball without anyone falling out:

Thanks for the link. It gives me all the info I need including where to go if my LL still doesn't take action regarding the GSC. I appreciate the quick response.

You could suggest that if it is not done before xxxxxx to will arrange yourself and deduct the cost plus a admin charge of xxxxx out of the next rent payment.

He could, but since...


...we have an amicable relationship...
...I don't want to fall out with my LLs
...I don't want to report my LL or cause trouble...

So, not really a great course of action for the OP until he's explored the suggested alternative.
