i have currently got a tenant in my flat - he is on dhss n he wants to move out and i want to move back in - dhss are saying they will not re-house him if he just leaves at end of tenancy agreement unless he is thrown out by court order even though it's in mutual agreement.is there any way that i can evict him without having to go through the rigmorole of court orders and solicitors?

If he wants council housing, he will be making himself voluntarily homeless - he'll have to join the queue.

If he wants to rent in the private sector - he can transfer whenever.
