Service charges/lease extension

Hi

Is it possible to challenge service charges at the LVT if they were made before a lease extension was granted?

i think you can do so

If the extentsion was done by way of a deed of surrender and regrant I believe you cant, the old lease was surrendered which means the benefit you may have had under that lease was given up.

If it is done by a deed of variation then I believe you can.

It will depend on the terms of the Deed of surrender and Regrant (esp. whether each party's existing rights were preserved despite completing it).
