View Full Version : Landlord of restaurant/flat- flat tenant complains re noise etc.

I bought a commercial property last year with a one bedroom flat on the first floor and a restaurant on groundfloor. I've just received a letter from the tenant upstairs complaining about the restaurant as he says that the restaurant is too noisy and wanted me to install some kind of noise protection? His complaint has nothing to do with late night, this is during
the day and he is well aware that the groundfloor has always been a trading place since he moved in about 17 years ago.

My question is that as the lanlord do I have any obligation to this request or anything I should do as a landlord? I passed his letter to the restaurant owner though.

Just found this, unanswered.
As L, you have - at least - an obligation for "quiet enjoyment". That doesn't necessarily mean keeping ground-floor tenant quiet but you as L of both may be required to enforce a breach of covenant/obligation by lower tenant at behest/cost of upper tenant.
