View Full Version : Can tenant appeal again re my eviction order?
took tenants to a full hearing to evict them, won the case, tenant made an immediate appeal which was rejected. He claims he may appeal to another judge if this happens, how long does it usually take for an appeal hearing.
Also if he doesn't appeal and waits for the bailiffs how long does it take usually to get them in.
Any help much appreciated

If he does not appeal within 21 days, he is "out of time" but can still lodge an application for the appeal to be filed out of time - this is likely to be granted if there are particular circumstances as to why he could not get the appeal papers filed within 21 days.
He can apply for the Warrant of Possession which is given to the bailiffs to be suspended on terms - usually these are very short notice hearings within a few days of the planned eviction date. Have a word with the local bailiff manager when you apply for the Warrant of Possession as to how long it will be before they can give you an appointment.
